Sterling forced to sell Clippers? Not a Slam-Dunk.. Not By a Long Shot

~ You can't separate a President from his beloved basketball

We are SO G-D sick of this topic..  truly we are..

More the way the media covers it and how pretty much everyone misses the bigger points like missing the forest for the trees...

So when pretty much 100% of the media presents misleading information on any topic that is in the national discussion, we for better or worse, take it upon ourselves to present the contrarian view;  the truth.

There's been a lot of talk in the media about that pencil-neck NBA Commissioner Adam Silver''s punishment (we feel excessive punishment) of LA Clippers owner Donald Sterling
`"Actually block me and my Secret Service guys will shoot you..."

He was barred from anything directly to do with the team, fined $2.5 million and a group of greedy, self-serving parasites known as the NBA owners will vote to force Sterling to sell the team.

Now the media with rare exception treats this as a slam dunk, to pardon the pun; a done deal.. And for fun and shits and giggles have started speculating which famous rich black celebrities may line up to buy the team..

And everyone is happy..

Except..  Is that accurate?   Does Silver and the NBA have the power to legally force an owner to relinquish control of his/her team via a forced sale?
~ In a real game of basketball this would be called 'travelling'

Many people think 'yes'..

They're also wrong..

The best way to explain why is to quote from a recent Sports Illustrated article that dealt with this subject and all legal questions surrounding the Commissioner's ruling.

We warn the following will be long but its very important because it will present a legally factual argument for why the NBA over-extended its authority, information devoid in other venues discussing this topic..
~ The guy just can't stop playing basketball..

From SI.com (in blue font):  

"Sterling, an attorney, is regarded as one of the most litigious owners in professional sports. If there is one owner who would sue over expulsion, it's probably him. 

Sterling could seek a court injunction preventing the NBA from expelling him. Such a move would likely happen immediately after he is voted out. He could also file a lawsuit raising breach of contract and antitrust claims.

A breach of contract claim would contend that Sterling's contract with the NBA through his franchise agreement has been unlawfully severed. The NBA, however, is poised to stress that owners agree to language limiting opportunities for owners to sue the NBA and fellow owners. 
~ 'Presidential Multi-tasking'

In their franchise agreements, NBA owners agree to "waiver of recourse" verbiage. The language has the effect of eliminating opportunities for owners to pursue legal recourse against the NBA and fellow owners.

An antitrust claim would likely center on both California and federal antitrust laws, and contend that the NBA and its teams have conspired in an anti-competitive way to oust Sterling and make him sell his team at below-market value. 

Sterling would likely cite reports the NBA may be interested in Magic Johnson buying the Clippers as evidence the league is trying to force a sale to a specific buyer, rather than permitting open bidding. 

Sterling might also highlight Silver's remarks today that he's confident owners will oust him as evidence of collusive activity between Silver and the owners. 
~ "I just love playing against white guys.. 

If Sterling were to sue under antitrust law and prevail, he would also be entitled to treble (triple) damages. Several attorneys familiar with NBA litigation tell SI.com that the possibility of an antitrust lawsuit by Sterling is high.

The prospect of Sterling suing could be a source of worry to NBA owners for at least three reasons:

1. Sterling suing over franchise ouster could undermine the lifetime ban. The ban is intended to separate Sterling from the Clippers and the NBA, and as discussed above, Sterling likely has no viable case against it. 

If, however, Sterling sues over franchise ouster, it would be a high-profile lawsuit and he would remain in the news. Whatever distancing of Sterling is achieved through a ban could be lost in a high-profile case. It is also a case that could last years, as antitrust cases often do.

2. Sterling suing may lead to pretrial discovery, which could be designed in part to embarrass other owners and NBA officials of any bigoted remarks or beliefs on their part. Keep in mind, if Sterling is ousted because of racism, he would likely demand that evidence showing that other owners and officials are also racist be shared. 

He would use such information to portray his penalty as unwarranted and contradicted by the conduct of those who ousted him. Sterling might request emails and other records from owners and officials that depict them in a negative light. 

Sterling has owned the Clippers for 33 years, which suggests that he has had many interactions -- including private conversations with league officials and owners. If there are other owners who are racist or bigoted, it stands to reason Sterling knows who they are.

3. If Sterling wins or extracts a settlement, not only could NBA owners be on the hook for an expensive fee, but Sterling would seem victorious. The appearance of him winning in court would greatly detract from (the NBA's) lifetime ban."

So the NBA owners vote is only a first step of what will be many years of expensive litigation that in all likelihood Sterling will win..

If Al Davis could defeat the NFL legally during the days of Commissioner Pete Roselle, Sterling will trounce this large stork-looking creature.

The Commish is a weakling and a newbie..
~ "I totally blocked that child about half my height!"

He needed to show he had balls even though in reality he doesn't..  And all this ensures is the NBA playoffs this year can be completed while minimizing the financial hemorrhaging caused by the jackals and wolves at the door that would not stop until meat was supplied.

In a few years from now, all this bluster will be looked upon as a Pyrrhic victory when the NBA has to pay out millions upon millions in damages to Sterling..

But for the moment, the propaganda machine calls it a 'win'

Our Investment Hot Tip: Prisons

We at A&G as asked often about investing

What is a good stock or set of stocks to but to create a diversified portfolio?

What commodities do we like?   Any metals attract us?    Is it a smarter or safer investment to put money into foreign markets or keep domestically?  Etc..

And that's not really something we like to answer especially here because A&G was not set up for that purpose..

But today we will make a rare exception because we are desperate to figuratively cleanse the palate from the utter disgusting tripe we and most sensible people were forced to swallow the last few days vis a vis the cowardly NBA being the first sports entity to break through the thought-crime barrier and celebrate its role of Big Brother.
So what do we recommend investing in?

Something that is not a fad but rather a continual growth industry..

A business that knows how to maximize profits and has a never ending stream of domestic labor at its disposal and legally is allowed to undercut private businesses making and creating the same products and services..
Prisons.   Yep.. we're 100% serious.  Not tongue-in-cheek or satiric.

If what we write offends as not the type of investment strategy one can not in good conscience pursue, good for you..  But you certainly are the minority..  

And to be clear, we sincerely do not benefit in any way, shape or form whether you follow this advice or ignore completely.   We've nothing to sell ever at A&G..

We exist solely as a small beacon of contrarian "light" in a thick dense sky of conformity and lockstep thought..
So let's start with a basic concept you all better understand before we can continue explaining the economics of prison..   It is legal slavery; the one type of human bondage and trafficking the 13th Amendment to the Constitution did not outlaw..

"Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction."

This is very important to remember as we go on and as a means to judge whether this upsets your conscience and to the point of if/if not you choose to seek to financially profit off legalized slavery.
There are 2.3 million prisoners currently held in the US which represents 25% of all the prisoners detained around the world..

In spite of all you hear about prisoners having cable TV, air-conditioning and every right under the sun, please understand most if not all of this 'good life' ranting is bullshit..

And trust us, we are not bleeding-heart liberals writing this...

Prison is hell..  Which if you're a true investor, you're shrugging at that statement..

Let's put aside the fact that because of our prison system, the US is the only nation in the world where more men are raped annually than women (nearly 1 in 10 have been sodomized in prison according to a 2011 Justice Dept. study)
And ignore the fact most prison food is rancid and not edible because of financial deals made between prisons and the food suppliers that the differential between what some state governments are allotted for food and what is spent, is divvied up among the correction officers..

Prisoners truly are modern slaves:

1) A slave is forced to work under threat of physical or psychological threat.
2) A slave is considered owned property, an asset or commodity which can be sold.
3) A slave has restrictions on their liberties, including freedom of movement.
See the connection yet?

In addition, prisoners can be denied communication with their fellow inmates, or forbidden from voluntary associations including union membership.  Clearly, they are denied freedom to leave the prison, but they are also forced to work unpaid or for extremely low wages.

Prisoners are effectively being bought and sold to private corporations who are using them as cheep labor for private gains. There is also a market for younger and healthier prisoners because their healthcare cost make them less expensive to hold.

Private prison contracts allow the transfer of prisoners to state run institutions which is sorta like the days when an owner could sell his chattel to another owner without taking the slave into consideration..
Instead of breaking of families at the source like slavery of yore, now you force loved ones to travel hundreds if not thousands of miles farther to have any face to face contact during incarceration.

So lets get to the nitty-gritty of why prisons are so profitable and a great financial investment..

Right now as we write this there are almost 1 million prisoners doing simple unskilled labor including making office furniture, working in call centers, fabricating body armor, taking hotel reservations, working in slaughterhouses, or manufacturing textiles, shoes, and clothing...

Now because these are slaves.. um.. we mean prisoners, they are not legally entitled to receive minimum wage which would be $7.25/hour received if outside the prison walls..

$7.25 x 8hrs labor = $58/day before taxes bare minimum for a free person
Currently prison worker bees are getting paid somewhere between 93 cents and $4.73 per DAY!..

All legal too so unlike your classic sweatshop, you never have to worry about the police coming in with full battle regalia and busting things up, which means no threat of law enforcement disruptions

In an article in CNN Money, clothing maker American Apparel expressed how this is destroying their business...

"'We pay employees $9 on average,’ [a company executive] said. ‘They get full medical insurance, 401(k) plans and paid vacation. Yet we’re competing against a federal program that doesn’t pay any of that.’

[The private prison] is not required to pay its workers minimum wage and instead pays inmates 23 cents to $1.15 an hour. It doesn’t have health insurance costs. It also doesn’t shell out federal, state or local taxes.”
As an investor looking to maximize profits, this means prisons are expanding their workload with new contracts coming in all the time..

Prisons currently subcontract for major Fortune 500 companies such as Chevron, Bank of America, AT&T and IBM

That person booking your hotel or plane reservation or answering a question about your checking account?

Yep.. Could very well be an incarcerated worker...

And you never have to work about a declining labor pool..  More people are arrested and incarcerated today for petty crimes and misdemeanors than ever before...

Coincidence?   Maybe..
As we said before, we're not being satirical..  Not this time..

Investors, especially professional ones are cold-hearted soulless, bottom-line number crunching bastards and one must talk their language when presenting any information in the realm of investing opportunities..

There will be some who will have read this posting and think "Ughh.. Dear God!  I'd never invest in That!'..

But trust us, others are thinking.. 'MMm, those numbers do add up don't they..'

But do as you will..  Its a free country..

"The Chess Players"-- An A&G Fable

The NBA announced its decision on Clippers owner Donald Sterling..   A lifetime ban, $2.5 mil fine and the Commissioner will do everything in is power to force the sale of the team.

Just imagine if his personal thoughts and opinions had been Meant for public consumption rather than privately uttered then illegally recorded for destructive purposes...

Whew...

Fortunately the NBA does not have the legal authority to compel an owner to sell his franchise and this battle will be tied up in the courts for years.   But the Commish had to do something to appease the jackals so he tossed them some meat on bone..

Anyways, rather than keep writing and writing on this depressing topic, in the spirit of the great Aesop who wrote "The Ants and the Grasshopper" which was our inspiration for all we do, we're going to instead write a fable..

Tomorrow or Thurs when we next write, we move on to other issues that are more relevant and important
"The Chess Players"

Imagine two males playing chess.. an adult and a small child.

The adult has vast experience and is quite skilled at playing the game while the child has none, thus to compete against one another is quite unfair..   

So the adult basically plays the child and lets him win..

And the better the child gets, the longer the matches go on before the adult ultimately loses for the purpose of fairness and to see the child smile.
Now one day that child turns into a teen and ultimately becomes an adult 

The older man seeing that the younger man is now fully capable of holding his own decides to finally play chess properly and make a sincere effort to win..

And he does.. 

And the younger adult is Furious!  

He kicks the table and throws the pieces to the floor then gets up and tosses the chair.. 

A couple moments later, the young adult comes back, re-sets the chair, table and chess pieces and says in controlled tension, "Let's go again.."
The older adult is mortified and nervous but agrees..

They play again.. the younger man loses again..

And now he is so enraged, he is pounding the table with his fists then pounding into his thighs...  Muttering.. cursing under his breath... foam forming at the crevices of the mouth as he stares at the older man with hate and contempt;  Desire to kill..

But after a couple minutes of this reaction, the young man re-composes himself and says tight-lipped,  "Let's go again.."

The older man can only nod 'yes'; his mouth agape in a state of shock..

And fear...

So they play once more..  
This time the older man decides to lose again on purpose as he had so many times before when the young man was still a child, then a teen...

And the young man exclaims, "Now That is more like It!"

And the two men look upon each other across the table in silence for a few moments..

The older man knowing forever more how the game must be played to ensure harmony 

And his health.

The younger man.. simply nodding and smiling..
But the eyes are no less ice-cold than when he lost.

And he simply says, "Checkmate".

The 'Racist', the 'Girlfriend', the Salary Trail & the Need to Crucify

As much as we really don't want to be wasting our precious time, energy and brain power on this whole NBA racism thingy for another day, we feel we must..

Tomorrow, the NBA's commissioner will be doling out a punishment and everyone is salivating like blood-hungry jackals to see this ignorant senile old man who owns the LA Clippers, Donald Sterling eviscerated into little pieces

Of course had Sterling offended people of the Jewish or Muslim faith, Asian Indians, Native Americans, etc very few would give a fig..

We know LeBron and Michael Jordan wouldn't give a damn..

We certainly know race peddlers like Al Sharpton and Jesse Jackson wouldn't give two bleeps..
And as for Obama?

Since the President has been silent since his deeply ignorant Secretary of State John 'I Married a Multi-Millionaire' Kerry yesterday slandered Israel by calling it an 'Apartheid State' then apologized and back tracked...

Well we guess insulting the US' most important ally in the Middle East isn't as big a deal to Obama as the 50% of him which is black being offended that he can't pose for a pic next to a gold-digger..

And yes Sterling's half black/half Mexican (and not 'that' hot) girlfriend, or to be more accurate, mistress is a gold-digger.. a very conniving and greedy one at that..

According to the LA Times, Sterling's wife of 50 years Rochelle filed a lawsuit against the whore identified as V.Stiviano as "a married woman seeking to protect and recover community property in her individual capacity."
As the LA Times article goes on...

"Rochelle Sterling alleges that her husband used community property to buy Stiviano a 2012 Ferrari, two Bentleys and a 2013 Range Rover, worth a total of more than $500,000.

Sterling also allegedly gave Stiviano $1.8 million to buy a duplex on West 4th Street near the Beverly Center last December, according to the suit, which claims that Sterling additionally provided her with $240,000 for upkeep and living expenses.

The property was supposed to be held in the Sterlings’ name, Rochelle Sterling contends, but Stiviano has title and has refused to relinquish it. Arguing that the gifts were all allegedly made without Rochelle Sterling’s knowledge or consent, the complaint seeks their return along with compensatory damages.

The suit, which includes as defendants unnamed agents and employees of Stiviano, alleges that before the complaint was filed, Donald Sterling asked her to return the property. The complaint also says that Stiviano goes by several other names, including Vanessa Maria Perez, Monica Gallegos and Maria Valdez."
~ Ahh, so that's why Obama doesn't like Sterling.. he gave Putin a Clippers jersey..

No wonder the bitch secretly recorded her pretend-lover's personal thoughts then made the audio public to destroy his reputation and hurt him financially..

Of course most of the media doesn't care about this..

They sure did give a shit back in the late 1990s when Linda Tripp was illegally recording conversations with Monica Lewinsky about the Clinton affair and the cum stains on her clothing..

But this is different..  Here the illegal conversation recorder is to be feted as a heroine and in all likelihood, a future reality TV star

See in this country you can bleed the American people dry for billions if not trillions of dollars like Lloyd Blankfein of Goldman Sachs, Jamie Dimon of JP Morgan Chase and Maurice Greenberg, who was head of AIG during the 2008 crash and subsequent bailout...

And you can siphon money like Ben Bernanke and Janet Yellen at the Fed to keep the Wall St ponzi continuously afloat..

And you can choose not to prosecute anyone for their financial crimes like Eric Holder, the US Attorney General..

Nothing happens to you and few to none know or understand or care to understand the complexity of their criminality and deviance..
But say something perceived as racist?

God Almighty help you because yo' ass is gonna Burn!

Currently there are 14 players on the LA Clippers roster with 12 of them being black..  Do you know how much this anti-black 'racist' owner pays them?

Chris Paul made $18,668,000 this year

Blake Griffin made  $16,402.000

Danny Granger made $14,021.000

Between three black men who make a living putting a stupid orange ball into a red hoop, they received a combined $49+ million dollars

Add the total of all the black players on the Clippers and they received a combined $84.8 million out of a total of $102.8 million spent on the roster..

$84.8 million.

And his players felt the need to middle-finger the hand that literally writes them those big exorbitant checks..
~  Nothing says 'I won't accept racism' more than turning your shirts inside out while still playing a game to collect a large paycheck..

To give some perspective..

If a person made $75,000 annually from the time he/she turned 18 until retired at 70 (53 years of working), and zero tax was taken out, that would equal $3.975 million dollars..

Chris Paul made that amount in 18 basketball games (less than 25% of one season).

Meanwhile did you know that men working 40 hour full time weeks make less than they did 40 years ago?

In 2012, the latest year for which the Census Bureau has published an estimate, the real median earnings of men who worked full-time, year-round was $49,398. That was $2,272—or about 4.4 percent—below the peak median earnings of $51,670 in 1973."

Wonder why the President hasn't spoken on this?

Audio: Here's A More Relevant 'Gotcha' Recording

In the world we all live in today, triviality is treated as important and importance is treated as trivial..

Over the weekend the big brouhaha was the elderly near-senile owner of a sports franchise (which provides basketball entertainment and nothing more) being caught in a recorded conversation saying some comments which offended the black community

Even the President took time to respond to it

Now there was another recorded conversation a few months ago (Dec 2013) that was of far greater importance and significance to just about everyone and it garnered nary a peep, especially from our dear leader..

It was a conversation between Victoria Nuland: US-Assistant Secretary of State for European and Eurasian Affairs and Geoffrey R. Pyatt: United States Ambassador to Ukraine
Listening, it might not sound as sensationalistic as a very old man talking about blacks but you have to really listen and understand what's going on..

The conversation was detailing US government policy to manipulate the political situation in Ukraine in our favor including a discussion of who specifically we should back and place into what positions of power..

Just like playing with dolls or moving pieces on a chess board...

The highlight or lowlight comes at the 3:02 mark where Nuland who represents Obama and the US Government in European matters saying "Fuck the EU (European Union)"

The Race Game

What was the big news story this past weekend?

Something of an economic or financial nature that may impact Americans either for the positive or inversely?

Some domestic or foreign policy issue or scandal?

Nope..

The owner of a professional basketball team, the LA Clippers allegedly said some anti-black comments toward his half black/half Mexican girlfriend about how it was OK she sleep with black guys (think about that absurdity a moment) but not take photos with them or invite to Clippers games..

And the hornets' nest which is the black population became mightily stirred about..

Even the President took time from his endless recreation time to be an opportunist and speak on the matter just to ensure he could incite those perhaps on the fence...

"If I had a son, he wouldn't be like that Clippers owner.."   Just a little Trayvon reference there

Now the players on the team could have protested by not playing but that would have meant money-first athletes putting principle before paycheck.
Yeah, right!

And to be honest no matter what absurdities the team owner said, for guys making 6-8 figure salaries to try to punish the person issuing their bloated paychecks is truly biting the hand that feeds..

Sorta reminds of a 'which is truly Worse' scenario:  An employer offering a position at $500k annually and refusing to hire any black candidate while phony politely complimenting those applicants by blowing complimentary smoke up their rears..

Or the employer saying "Nigger, you're hired!"?

So why would this be a big deal; a major story?

Remember just earlier this week the Supreme Court in a large majority said individual states could vote down affirmative action, the sacred golden goose of a segment of the black population who covet the crutch

Its also no small coincidence that the rancher in Nevada who stood up to the domineering Federal Government over the issue of grazing rights suddenly was thrust in the spotlight for making the analogy that blacks today are given as many gifts and freebies by the government as they did from their slave masters in the day...

Race stirs up anger.. that stirs up passion.. and that stirs people to donate to political candidates and causes and the ultimate goal by those who manipulate the situation..

It stirs people to get off their soft cushy arses and vote.

Few vote out of contentment..  They do so out of fear and/or anger.

There is no genuine discussion on race in this nation..  Hasn't been a sincere attempt since maybe the very late 1950s when Dr King was just beginning to be a national name..

Pretty hard to have a open dialogue when one side is scared poop-less of being too honest and dealing with financial blowback while the other side will defiantly not concede a single point or accept any role in their current perception..

And the word 'racist'..  Just tossed around so cheaply; the true meaning and significance of the word gets bastardized and the one doing the accusation has all the power.. the intended target has to go on the defense.. frantically defend themselves..

There's 'racist'  and then there is 'Racist'
The capital-R racist is someone who will use their position of power and/or authority to deny a person of a different race a job or a bank loan, or steer that person to another community when the other is house-hunting..

A capital-R racist will also use threat, intimidation and/or physical force to bully their will upon another person.

Those are repugnant people.

The lower-case 'r' racist..  They pre-judge, but is that really wrong?
For instance, if a white person only votes white candidates into office, is he/she a racist?

What about the 99.999% of blacks who twice gave their vote in complete lockstep to Obama?

Is a white person who chooses to attend a university that is pretty much devoid of black students a racist?

What about the black student who purposely chooses a black college, or who goes to a multi-racial campus but will only pledge a black fraternity or sorority?

If white parents do not want their children, especially their daughters to procreate with blacks and have bi-racial children, are those parents racist?

What if it is black parents who insist their children date and mate with their own to preserve their culture and lineage?

We all have some level of racism in us because small letter 'r' racism is really about personal preference; the right to choose who we socialize and congregate with and whom we wish to speak to.

Despite most of the bullshit which is social engineer-driven TV, most blacks and whites are Not friends outside school or work, most do not 'hang out' or eat together off the clock and events like get-togethers, parties, weddings etc usually are among people of one's own kind..

Just the truth of things..  It is simply a matter of preference..

Red or Blue tie?  Coffee or Tea?

Some people prefer only socializing or dating those of their own kind.. or their own religious or cultural background.. some even prefer the social or sexual company solely of their own gender..

Ultimately that's every individual's right.

Its only when an individual or collection take it upon themselves to deny a person of a different background their freedom to pursue their happiness, where it becomes a bad thing; capital-'R' Racism..

The truth is that a person has a right to like or not like another person or group for any reason(s) they wish no matter how sensible or stupid and understand he/she will be equally judged by others.

Ideally its best everybody love everybody but that's just not how life is..

Sometimes we base who we like/dislike or who we wish to befriend or date based on skin color or religion or nationality..  or weight or height or eye/hair color or one's voice..   or a million other subconscious criteria..

Should one feel guilty they don't wish to date a person with a lot of freckles or someone who politically is 180deg polar opposite or to feel a mistrust toward someone of a particular background based on hundreds or thousands of years of history as precedent??

It reminds us of a comedy skit from the 1990s show 'Kids In The Hall'..

There was this local jam making contest where all the townsfolk submitted their very best batch for the competition judge, the Mayor to decide..

Ultimately he picked one in particular as the best by far..

The crowd gasped in horror and one exclaimed "You just chose the jam of a child molestor!"; a person who was still in prison but made jam as part of his work-release program.

The mayor's career was forever ruined.

All because of nothing more than personal preference and the idiocy of connoting that right of choice to outside factors.

As we said, there will never be a true discourse and thus a true understanding and common ground on race..

Most whites don't want to get crucified so they reteat and most blacks don't want to give up their power cards or take any share of the blame for the deterioration of relations.

And the only ones left on the field of battle are the opportunists, the race peddlers/baiters and the true capital 'R' Racists
So you have a society of horrible white guilters, vile black language bullies and everyone else in the middle is forced to cower and hide from the topic that is part of our daily lives whether we like it or not..

This is the face of a truly 'politically correct' society.
